These Terms and Conditions (“Terms”) govern your use of this website and your interactions with White River Environmental Services LLC (“White River,” “we,” “us,” or “our”). By using the website, you agree to these Terms. A written quote, work order, rental agreement, service agreement, credit agreement, or other signed document may contain additional terms; if there is a conflict, the signed document controls for that service.
Website content is provided for general information and may not describe every service, site condition, limitation, fee, permit, or availability requirement. Quotes are based on the information available when issued and may change if site conditions, quantities, access, disposal needs, taxes, regulatory requirements, or requested work changes. A quote is not a guarantee of scheduling or availability unless confirmed by us.
Service dates and arrival windows are estimates and may be affected by weather, traffic, equipment, disposal facilities, emergencies, unsafe conditions, or circumstances outside our control. You must provide safe, lawful, and sufficient access to the service location and identify gates, codes, septic components, utilities, hazards, restricted areas, and other relevant conditions. We may pause or decline work that we reasonably believe is unsafe, unlawful, inaccessible, or materially different from what was described.
You are responsible for additional costs reasonably caused by inaccurate information, concealed or changed site conditions, blocked access, prohibited materials, or work requested beyond the agreed scope.
Rental equipment remains our property unless a written agreement says otherwise. Customers must not move, alter, damage, overload, misuse, sublease, or permit unauthorized servicing of rental equipment. The customer is responsible for reasonable loss, damage, contamination, relocation, or excessive cleaning charges arising during the rental period, except to the extent caused by our negligence. Placement must remain accessible for delivery and service vehicles and comply with applicable rules and site requirements.
Subsurface and waste-service work can involve conditions that are not visible before work begins. Unless expressly included in writing, we do not guarantee the condition, capacity, location, code compliance, remaining life, or performance of customer-owned tanks, lines, drain fields, traps, utilities, soil, or other systems. Customers must accurately identify waste contents. We may reject hazardous, regulated, incompatible, or undisclosed materials and may charge reasonable handling, testing, transport, cleanup, or disposal costs required by actual conditions and law.
Prices, deposits, payment timing, cancellation terms, recurring rental charges, taxes, and other fees are stated in the applicable quote, invoice, or service agreement. Amounts not disputed in good faith are due as stated there. To the extent permitted by law, the customer may be responsible for reasonable costs incurred to collect overdue amounts. Contact us promptly if you believe an invoice is incorrect.
When you provide contact information, you authorize us to use it for quotes, scheduling, service, billing, safety, and account communications. Promotional communications require any consent required by law. Consent to promotional text messages is not a condition of purchase. Message frequency may vary; message and data rates may apply. Reply STOP to promotional texts to opt out and HELP for help.
The website, branding, photographs, graphics, text, and other content are owned by or licensed to White River and are protected by applicable law. You may use the site for personal or legitimate business inquiries. You may not interfere with site security, attempt unauthorized access, scrape or copy substantial site content, introduce malicious code, impersonate another person, or use the site unlawfully.
To the fullest extent permitted by law, the website is provided “as is” and “as available.” We disclaim implied warranties regarding the website, including merchantability, fitness for a particular purpose, and non-infringement. Service warranties, if any, are only those expressly stated in a written agreement. Nothing in these Terms limits warranties or rights that cannot lawfully be excluded.
To the fullest extent permitted by law, White River will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from website use or services. For claims that may lawfully be limited, our aggregate liability will not exceed the amount paid to us for the specific service giving rise to the claim. These limits do not apply where prohibited by law or to liability that cannot lawfully be limited.
To the fullest extent permitted by law, you agree to indemnify and hold White River and its personnel harmless from third-party claims, losses, or expenses arising from your unlawful use of the website, your breach of these Terms, prohibited or undisclosed materials, unsafe site conditions within your control, or your misuse of rental equipment, except to the extent caused by White River’s negligence or willful misconduct.
Links to third-party websites or social platforms are provided for convenience. We do not control and are not responsible for their content, availability, products, security, or privacy practices.
These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law principles. Any dispute not resolved informally will be brought in a state or federal court with jurisdiction in Arkansas, unless applicable law requires otherwise. Before filing a claim, please contact us and allow a reasonable opportunity to address the issue.
If a provision is found unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations without our consent; we may assign these Terms in connection with our business. We are not responsible for delay or failure caused by events beyond our reasonable control.
We may revise these Terms by posting an updated version with a new effective date. Continued website use after a revision means you accept the updated Terms.
